Mediation offers an alternative and efficient approach to resolving workplace issues, distinct from the conventional investigation or litigation processes.

This process is informal, with a neutral third party playing a crucial role in facilitating voluntary discussions, negotiations, and conflict resolution.

Neutral third-party mediators do not impose decisions on the parties involved but rather assist them in reaching mutually acceptable resolutions.

Mediation provides both parties with the opportunity to thoroughly discuss the issues, clarify misunderstandings, identify interests and concerns, seek common points of agreement, and translate them into concrete solutions.

On the other hand, litigation has several drawbacks:

Benefits of Mediation in Resolving Workplace Conflicts

Legal proceedings are lengthy and costly. Compared to mediation, the outcomes of judicial procedures are often uncertain.

The parties have the authority to determine the terms and process of settlement. The mediator has no means of determining guilt or innocence between them.

Mediations are expeditious and typically conducted in a single meeting. They do not require legal representation.

It Enhances Communication

Mediation, being confidential and non-adversarial, provides an environment where both parties can express their views openly.

It Promotes Collaboration

Mediation offers a practical approach that reduces conflicts and disruptions by gaining a better understanding of issues affecting the workplace.

The third party and the opposing parties may sign a confidentiality agreement if agreed upon. Mediators are not obliged to disclose any information disclosed during the session to anyone else.

Initiating Mediation

The mediation process should be conducted by an experienced and skilled mediator. It should be attended and actively participated in by representatives from both sides. Legal counsel or other representation for both parties may also attend as needed.

Both parties must overcome the misconception that they should not attend mediation, believing they did nothing wrong. Mediation efficiently uses time and resources by ending the conflict with an agreed-upon resolution.

Evaluation and Conciliation

If mediation fails to result in a settlement, the case or complaint would be referred for evaluation, typically to the relevant government agency.

A qualified investigator may ask the subject of the complaint or charge to respond to the allegations and provide relevant documentation to support their response. They would request a written reply, though on-site visits may be conducted to interview witnesses and verify information.

If the subject of the complaint or charge fails to provide the requested information, the investigator may issue a subpoena for access, documents, or testimony.

Once such information is obtained, the investigator would then determine whether to proceed with the investigation, offer a negotiated settlement, or dismiss the charge.

Investigators may opt to dismiss the charge if there is insufficient evidence to conclude a violation. The rationale for the decision should be explained to the complainant or charging party.

However, if the investigator believes there is reasonable cause for the charges, they should explain the basis to the subject of the complaint or charge.

Both parties are subsequently invited to engage in conciliation discussions to resolve their conflict without going to court.
